A trio of lawmakers introduced an article of impeachment Monday, seeking to charge President Trump with ‘incitement of insurrection.’ A vote could come Wednesday at the earliest.
HOUSE DEMOCRATS ARE pressing forward with their efforts to impeach President Donald Trump for a second time during his presidency as members introduce articles of impeachment seeking to hold him accountable for his role in last week’s violent riots at the U.S. Capitol.

For 10 minutes on Monday morning, the House gaveled into a pro-forma session where House Majority Leader Steny Hoyer of Maryland asked unanimous consent to pass Democratic Rep. Jamie Raskin of Maryland’s legislation calling on Vice President Mike Pence to invoke the 25th Amendment for Trump’s immediate removal. Republican Rep. Alex Mooney of West Virginia objected, killing the effort. Democrats will now move to hold a floor vote on the bill Tuesday.

Once the legislation passes, House Speaker Nancy Pelosi of California will give Pence 24 hours to respond before Congress takes up articles of impeachment. If a majority of the House votes to impeach, Trump would be the first president in U.S. history to be impeached twice.

An article of impeachment formally introduced Monday by Raskin, Rep. David Cicilline of Rhode Island and Rep. Ted Lieu of California has gained significant momentum over the past few days, seeking to charge Trump with “incitement of insurrection.” The resolution warns that Trump remains “a national security threat” and calls for impeachment, removal from office “and disqualification to hold and enjoy any office of honor, trust or profit under the United States.”
A number of articles have been circulated by Democrats, including two from Rep. Ilhan Omar of Minnesota and another likely to come from Rep. Al Green of Texas. But the one from the trio has nearly enough co-sponsors to pass, though it remains to be seen if any Republicans sign on. Freshman Rep. Cori Bush of Missouri has also said she’ll introduce a bill seeking to expel lawmakers who voted last week to overturn the 2020 election results and “incited a white supremacist coup that has left people dead,” arguing they have violated the 14th Amendment.

“In protecting our Constitution and our democracy, we will act with urgency because this president represents an imminent threat to both,” Pelosi wrote in a Sunday letter to her caucus. “As the days go by, the horror of the ongoing assault on our democracy perpetrated by this president is intensified and so is the immediate need for action.”

While the timeline for impeachment is still open-ended, the earliest the House will vote on a resolution is Wednesday – one week from President-elect Joe Biden and Vice President-elect Kamala Harris’ inauguration.

But even if the House imminently impeaches the president, there’s debate over when the articles of impeachment would be sent to the Senate.
Some have floated holding off on immediately sending them and potentially waiting to hold a Senate trial on whether to convict until Trump leaves office on Jan. 20. The full Senate is scheduled to come back into session on Jan. 19.
Others, like the authors of the impeachment resolutions as well as Hoyer, want urgent action.
“The Senate should come back immediately. Once we pass it, they should take it up immediately,” Cicilline told reporters in the Capitol on Monday. “This is urgent. This president represents a real danger to our democracy and, you know, obviously I’m not in control of the Senate, but they ought to come back immediately and respond to this urgent circumstance we’re confronting.”

In a Sunday interview with CNN, House Majority Whip Jim Clyburn of South Carolina signaled that a Senate trial could be delayed.
“We will take the vote that we should take in the House. And she will make the determination as to when is the best time to get that vote and get the managers appointed and move that legislation over to the Senate,” Clyburn said, referring to how Pelosi might proceed.
Once the articles are transferred to the Senate, both parties in the House name impeachment managers to present their case before senators. Once the trial wraps, the Senate would then vote on conviction, which would take a two-thirds majority.

Trump was first impeached in December 2019 over accusations that he pressured Ukraine’s president to interfere in the U.S. presidential election, but he was ultimately acquitted by the Senate in early 2020.
